Welcome to Gutly. Before you can use our application, it is mandatory that you agree to these Extended Terms of Use and Privacy Policy. The following terms apply to all users of our application. By accessing or using our services, you confirm that you have read, understood, and accepted these terms and agree to be legally bound by them. If you do not agree to these terms, you must not use our application or services.
Use of Our Services
Personal Use Only
Our services are intended for personal, non-commercial use. You are strictly prohibited from using our services for commercial purposes. This includes, but is not limited to:
- Reselling our services
- Copying or reproducing any part of our services for commercial use
- Utilizing our services in a manner intended to generate income
Health & Safety
Important Medical Disclaimer: Gutly provides tools for logging meals and symptoms and uses AI to surface potential patterns. Gutly does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional regarding any questions about a medical condition. Do not ignore or delay seeking professional advice because of information you obtained through the app. If you are experiencing a medical emergency, call your local emergency number immediately.
Prohibited Uses
You agree not to:
- Misuse or interfere with the proper functioning of the app
- Upload unlawful, harmful, or infringing content
- Attempt to access accounts or data that are not yours
- Use automated means to scrape, harvest, or index the service
Software Protection
In accordance with copyright and other applicable laws, you are not permitted to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of our services. Any violation may result in immediate termination and potential legal action.
Age Eligibility
You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use Gutly. If you are under 18, you must have permission from a parent or legal guardian.
Subscription Details (iOS Only)
Gutly operates on an auto-renewing subscription available exclusively on iOS via the Apple App Store's in-app purchase system.
Billing & Renewal:
Your Apple ID will be charged at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
Manage Subscription:
You can manage and cancel your subscription at any time in your iOS Settings > Apple ID > Subscriptions.
Trial Periods (If Offered):
If Gutly offers a free trial on iOS, any unused portion is forfeited when you purchase a subscription (where applicable).
Refunds:
Refunds are handled by Apple in accordance with Apple's policies. Gutly does not issue refunds directly.
Price Changes:
We may change subscription pricing in the future. If pricing changes, Apple may notify you; continued use after the change constitutes acceptance. You may cancel before the new pricing takes effect.
You are responsible for all charges incurred through your Apple ID.
Disclaimers and Limitation of Liability
Services Provided “As Is”
Our services are provided on an “as is” and “as available” basis, without warranties—either express or implied—of any kind. To the maximum extent permitted by law, Gutly disclaims all implied warranties, including, without limitation, merchantability, fitness for a particular purpose, and non-infringement.
AI & Data Accuracy
Results surfaced by our AI may be incomplete, imprecise, or context-dependent and should be considered informational only—not a substitute for professional judgment.
Limitation of Liability
To the maximum extent permitted by law, Gutly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use or inability to use our services.
Indemnification
You agree to indemnify, defend, and hold harmless Gutly, its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of our services, or your breach of these Terms.
Termination and Modification
Termination
We reserve the right to suspend or terminate your access at any time without prior notice, especially if you violate these Terms.
Modification of Terms
We may update or modify these Terms at any time. Changes will be posted in-app or on our website. Your continued use after changes become effective constitutes acceptance of the new terms.
